Liability and Warranty Terms for Business Customers (B2B)

1. Scope of Application
These Liability and Warranty Terms apply exclusively to business customers within the meaning of the Austrian Commercial Code (UGB).
Sales to consumers are excluded.
2. Warranty
The customer must inspect the goods immediately upon receipt.
Any apparent defects must be reported to us in writing within 7 days of delivery.
Hidden defects must be reported without undue delay after discovery.
In the event of justified defects, we reserve the right, at our discretion, to remedy the defect or provide replacement goods.
Any further claims are excluded to the extent permitted by law.

3. Limitation of Liability
To the extent permitted by law, our liability is limited to cases of intent and gross negligence.
Liability for slight negligence is excluded.
Our liability shall be limited in amount to the value of the goods supplied in the respective transaction.
4. Exclusion of Certain Damages
To the extent permitted by law, we shall not be liable for:
- Indirect damages
- Consequential damages
- Production downtime or production losses
- Loss of profit
- Damage resulting from further processing of the products
5. Product Specifications and Use
The products supplied are intended for commercial use.
The customer is responsible for independently verifying the suitability of the products for the intended application.
Technical data, product descriptions and recommendations do not constitute guaranteed characteristics.
6. Certifications and Standards
Information relating to standards and certifications, including EN standards, is provided to the best of our knowledge but without guarantee.
The customer is responsible for independently verifying compliance with the standards and regulations applicable to the intended use.
7. Import and Use
The customer is responsible for compliance with all applicable legal requirements in the country of destination, particularly with regard to:
- Product safety
- Labelling requirements
- Import and customs regulations
8. Force Majeure
We shall not be liable for delays or damages resulting from events of force majeure.
9. Final Provisions
Should any individual provision of these Liability and Warranty Terms be or become invalid, the validity of the remaining provisions shall remain unaffected.
